Bankruptcy Petition Preparation Services

All information provided by the attorney is subject to the same protections under attorney-client privileges and is handled with the upmost care to ensure security and privacy.

Although the work performed is thorough and expected to be relied upon, the responsibility is on the attorney to ensure the information provided on behalf of the client is truthful and accurate.

The work performed by the paralegal is done so under the direct supervision of the attorney and is prohibited from practicing law, to include but not limited to providing legal advice.

Each project may include more than one draft given the unique situation of each client/case, such as updates throughout the progression of the case.

 

An invoice will be provided upon completion of the petition.

 

Emergency/Barebones cases are subject to additional fees.

  • Petition is drafted utilizing bankruptcy software

  • Due diligence can include the following:

    • public record's search​

    • PACER search

    • vehicle value search

    • home value search (includes county appraiser info)

    • other real property value search

    • business entity verification (utilizes state secretary sites or equivalent)

    • review credit report(s) for accuracy & consistency 

    • review of ​​

      • relevant contracts & agreements 

      • financial documents

      • all client docs provided by attorney

    • relevant existing litigation matters 

  • Review and suggestion of potential exemptions

Barebones | Skeleton | Emergency Petition

This service is typically for debtors facing a foreclosure or eviction (etc.) with the expectation of filing within two to three weeks or sooner. 

​

As such, only the most pertinent and basic information will be drafted for emergency filing until the remaining details can be added to the petition.

​

The following can be included in the barebones draft:

  • All secured/priority creditors (Creditor matrix or mailing list)

  • Any dismissal orders pulled from PACER relating to recent prior/current bankruptcies (will be used to determine motions to extend, impose, or reimpose stay) 

  • Statement of Social Security Numbers (Form 121)

  • Form 101​​

    • ​Debtor's basic information to inform the court​

    • Credit Counseling Certificate​​
